Childcare, telework: a whole organization to review with the closure of schools
On Wednesday March 31, 2021, Emmanuel Macron announced a new confinement from Saturday evening for four weeks, for the whole of France. Added to this is the closure of nurseries and schools for a period of three weeks, colleges and high schools for four weeks and an adaptation of the school calendar.
As a result, it is the return of the galley for some parents who will have to manage to have their children looked after, while the president recalled that telework must be "systematized".
On Friday April 2, however, the government clarified that childminders may, if they wish, continue to work for the next three weeks. Otherwise, they will be placed on partial unemployment with compensation at 80% of net salary.
How to keep your child in this context? Several devices exist.

On Monday April 26, kindergarten pupils and primary will resume classes “physically”, and remotely for colleges and high schools. You are a private sector employee and cannot telecommute
Even if telecommuting can be deployed more widely, not all professions allow this organization of work.
Also, private sector employees unable to telecommute may request to benefit from partial activity to keep their child, details the Ministry of Labor in a press release.
The conditions for benefiting from partial activity for childcare:
How to benefit from it:
The employee must give his employer a sworn statement “indicating that he is the only one of the two parents requesting to benefit from partial activity on the grounds of childcare”.
Until now, in the event of school closure, proof of closure of the establishment was requested. For the moment, neither the Ministry of Labor nor Health Insurance has been able to tell us if this proof is still necessary.

You are a private sector employee and you can telecommute
This is probably the most uncomfortable scenario: mixing telecommuting and childcare at home. Many people experienced it during the first confinement, with the difficulties that this implies.
Once again, if one of the two parents can telecommute, the government considers that the children can be kept at home. A work stoppage for childcare can however be requested.
The conditions for benefiting from the stop for childcare:
How to benefit from it:
The employee must provide his employer with a sworn statement, specifying that he is the only one of the two parents to benefit from a work stoppage, recalls the Ameli.fr site. Here too, for the moment, it is impossible to know whether to provide proof of school closure.
The employer will then make a declaration of partial activity, with compensation of 84% of net remuneration or 100% for employees with the minimum wage, and no remainder to be paid by employers.

In this case, you have to apply for sick leave yourself. The declaration can be made on declare.ameli.fr or declare.msa.fr (agricultural regime) with the possibility of declaring the stops retroactively.
Note that for the last three categories (vocational training trainees; public administration contract workers; part-time civil servants working less than 28 hours), the declarations must be made by the employer (sector public or training organization).
These work stoppages for childcare make it possible to benefit from daily allowances "without verification of the conditions for opening rights, and without taking into account the maximum durations of payment without a waiting period".
As for the proof of school closure to be provided, no precision there either on its necessity or not.

And if not, the grandparents?
And if you prefer the classic childcare method, grandparents, Prime Minister Jean Castex clarified Thursday before the deputies that it will be possible to travel for this reason for childcare despite the restrictions of shift.
The Prime Minister indicated that among the compelling reasons for traveling outside his department were "those related to a family reason, such as accompanying or picking up a child from a parent, grandparent or a relative ".
And if, despite everything, none of these solutions are possible for you, all you have to do is arm yourself with patience and have a good sense of resourcefulness. Ask for paid leave, RTT? Do without ? Four weeks can be as quick as it is long… We sympathize.
